Matter Types Explained

Below is a list of the primary Patent and Trademark matter types that comes standard in AppColl.  Please note that you can add as many custom matter types to your account as desired. Please let support know what you would like added.

 

Patent

  • Design – This is for a standard design patent whether U.S. or foreign. Feel free to use this for any country. Some may prefer to use “Design Foreign”, which we can add. Either is appropriate. 

  • Plant - This is for a standard plant patent whether U.S. or foreign. Feel free to use this for any country. Some may prefer to use “Plant Foreign”, which we can add. Either is appropriate. 

  • Utility: Provisional – This is for a standard U.S. Provisional application. You are not restricted to only using this for U.S. cases. You can certainly enter a different country. However, we recommend having us create a custom matter type such as Utility: Foreign Provisional.

  • Utility: Non-Provisional - This is for a standard U.S. Non-Provisional application. You are not restricted to only using this for U.S. cases. You can certainly enter a different country. However, we recommend using Utility: Foreign if it’s a direct file in a foreign country.

  • Utility: Continuation – This is for a standard U.S. Continuation. You are not restricted to only using this for U.S. cases. You can certainly enter a different country. However, we recommend having us create a custom matter type such as Utility: Foreign Continuation.

  • Utility: Continuation-in-Part - This is for a standard U.S. CIP. You are not restricted to only using this for U.S. cases. You can certainly enter a different country. However, we recommend having us create a custom matter type such as Utility: Foreign Continuation-in-Part.

  • Utility: Divisional - This is for a standard U.S. Continuation. You are not restricted to only using this for U.S. cases. You can certainly enter a different country. However, we recommend having us create a custom matter type such as Utility: Foreign Divisional.

  • Utility: Model – This is for a standard Utility Model. Choose the appropriate country.

  • Utility: National Phase – This for applications that have entered the National Phase of a PCT application. Also known as a 371 application. If you are entering the U.S. through National Phase, we recommend using the Utility: National Phase matter type and selecting U.S. as the country. This will still trigger U.S. patent tasks, just like “Utility: Non-Provisional” would.
     
  • Utility: Foreign - This is for patent applications that are directly filed in a non-U.S. country and not through National Phase.

  • Utility: PCT – This a standard PCT application. Please use WIPO (WO) as the country.

  • Utility: Reissue – This is for a standard U.S. Reissue application.

  • Utility: Reexamination – This is for a standard U.S. Reexamination application.

 

Trademark

  • State Trademark – This is for a state-specific trademark. Once selected, you would enter the appropriate state.

  • Trademark  - This is for a standard U.S. or foreign trademark. We can add a Trademark Foreign type if you prefer to keep these type separate.

  • Trademark Madrid – This is a for a Madrid-filed trademark. You will want to use “Madrid” as the country.
